Terms of Use

These Terms of Use ("Terms") govern access to and use of the JamList application (the "Service") and set out the rights and obligations of the parties. Creating an account implies full acceptance of these Terms.

1. Purpose of the service

JamList is an application for music bands. It lets members propose songs, vote on tracks to rehearse, organize rehearsals and concerts, and track the evolution of their shared repertoire.

2. Access to the service and account creation

Access to the Service requires creating an account, either independently or by invitation to an existing band via an access code.

Users agree to provide accurate information when registering and to keep their login credentials confidential. They are solely responsible for any activity carried out from their account.

Users under 14 must obtain the consent of their legal guardian before creating an account, in accordance with Quebec's Act respecting the protection of personal information in the private sector (Law 25).

3. Content published by users

When using the Service, users may publish content such as: display name, avatar, band name, proposed song titles, votes, availability for rehearsals ("User Content").

Users remain solely responsible for the User Content they publish. They agree not to publish any unlawful, abusive, defamatory or discriminatory content, or content infringing a third party's rights, including intellectual property rights.

By publishing User Content, the user grants JamList a non-exclusive, free license, limited to the duration of use of the Service, allowing that content to be displayed to other members of the relevant band(s), solely for the purpose of operating the Service. This license does not transfer any ownership to JamList.

4. Moderation and reporting

Any user may report User Content they consider inappropriate or unlawful by writing to contact@jamlist.app, specifying the content concerned and the reason for the report. JamList undertakes to review each report within a reasonable time and to remove manifestly unlawful content where applicable.

5. How bands work

Each band is created by a user ("band admin") who can invite other members via an access code and remove a member from the band. Data and content shared within a band (songs, votes, rehearsals, concerts) are visible to all members of that band.

6. Third-party content and services

JamList lets users search for songs via third-party services (Apple iTunes Search API, YouTube) to display metadata (title, artist, artwork) or embed videos. JamList does not host, store or redistribute any copyrighted audio or video file: this content remains hosted and provided by the relevant third-party platforms, subject to their own terms of use.

7. Service availability

JamList is a continuously evolving service. The publisher strives to ensure continuous access to the Service but does not guarantee uninterrupted availability and may temporarily suspend access for maintenance purposes, without incurring liability.

8. Termination

Users may request deletion of their account and data at any time by writing to contact@jamlist.app. JamList may suspend or delete an account in the event of a serious breach of these Terms, following prior notice where possible.

9. Liability

JamList uses reasonable means to ensure the security and proper functioning of the Service, without any guarantee of results. JamList cannot be held liable for indirect damages resulting from the use of the Service, nor for content published by users.

10. Governing law and disputes

These Terms are governed by the laws applicable in the province of Quebec and by applicable federal Canadian law. In the event of a dispute, and failing an amicable resolution, the competent courts of the judicial district of the publisher's domicile, in Quebec, shall have sole jurisdiction.

11. Changes to these Terms

JamList may amend these Terms at any time, in particular to reflect changes to the Service or applicable regulations. Users will be informed of any material change.
